University Declaration

The German University in Cairo does regret the sad events taking place within and around its premises within the last couple of days. Those events have been triggered by some of its students performing riots and transgressions that threatened the dignity of the academic faculty members and jeopardized the safety of ����һ������ students and buildings. This has led the university to take the necessary measures to maintain the dignity of its academic faculty members and to ensure their safety, as well as the safety of its students and to continue with its role in providing the scientific and academic environment needed for graduating its students at a high scientific level that can compete with their local and international peers. To achieve this end, this requires the cooperation of all parties involved, namely parents, students, faculty members and administration in an environment conducive to production and advancement without wasting any time or effort that are badly needed to help Egypt recover what it has missed in its path towards scientific international advancement without breaching the university regulations and bylaws.

Everybody should have an equal chance to freely express their opinions within the framework of objectivity, curtsey, guarding the established codes of ethics, and pre-coordination with the university administration regarding all their needs and aspirations; provided that they fully respect the educational process in the university as well as those working to maintain it and provided that they do not disturb, or break into the university labs and buildings nor endanger students and buildings. We have great trust in the cooperation of all to achieve this superior aim to work on pushing the educational process in Egypt forward and to recover what we have missed in decades that have deprived us from keeping abreast with developed countries as we deserve.

Therefore, ����һ������ is keen on clarifying the following:

Taking into consideration what Egypt is going through at this critical stage which is quite vague and at a time when truth and reality are not clear cut leading to the arising of contradictory inclinations and trends trying to impose their ideologies on the other entities including universities and students – thus leading to possible confrontations with varying levels of intensity. Therefore, the university on its part asserts the following:

1. Universities are by nature nonaligned, impartial and independent as an edifice for education built on values and mutual respect among all university entities, be they academic faculty members, administration, or students, as well as within each entity regardless of political, religious, and ideological inclinations – within the framework of national and international established university norms.
2. The students expelled whether temporarily for two weeks (three students) or permanently (two students previously summoned and formally warned by the disciplinary action committee) were expelled due to verbally abusing and insulting the disciplinary action committee members and slandering them in a way unacceptable from a university student – and not on account of the students' political inclinations. The motive behind all previous disciplinary actions have been purely educational and administrative and had nothing whatsoever to do with politics.
3. The university is keen on its dignity as represented by the dignity of its academic faculty members, its employees, and its students and will not accept any verbal or physical insult and/or assault to any of them in a way that obstructs their educational mission fulfillment.
4. The university assures the students' rights concerning freedom of expression within the framework of respecting one's opinion as well as the other opinion without infringing the welfare of the other and without negatively affecting the educational process.
5. The university has several times warned against getting into buildings, obstructing the educational process, and assaulting colleagues in order to preserve the educational process and to guarantee the safety of the students themselves. Official correspondence dated 1st of March 2011, 22nd of March 2011, 13th of November 2011, and finally 22nd of February 2012 was sent to that effect.
6. The university does not take sides, does not support nor oppose any political group since universities are independent and are politically and ideologically neutral. This is exemplified by the case of the teaching assistant whose contract has been terminated. He was not summoned for investigation on grounds of his political beliefs nor due to his participation in the protests against The Supreme Council of the Armed Forces (SCAF), as was thought and accordingly accused by the students who claimed that the university punishes its students and TAs for their political beliefs. The simple answer to that is as follows: the teaching assistant suspended is a university graduate and was vice president to the former student union and he was appointed by the university despite the claims that there is a dispute between him and the university on account of his prior stance as a vice president to the student union. If such a claim were true, it would have been easier not to appoint him to start with. The real reason behind taking disciplinary action with him is as follows:
   • He violated the duties of his position that require utter objectivity towards all students as he aggressively attacked the current student union in an e-mail he had send in which he accused them of being illegal and traitors to the students' struggle. He also shouted at the current student union president –in a student meeting - asking him to resign. In the same meeting, he was aggressive towards an administrative colleague of his.
   • On the 26th of February 2012, the above mentioned teaching assistant presented a formal apology to the university regarding his transgressions and promised to abide by the university regulations and bylaws. His apology is currently under consideration in order to take a decision soon in that concern.
7. The university has allocated areas for freedom of expression within its premises; those areas have been chosen so as not to obstruct the educational process and so as to ensure the safety of its students. Demonstrations, sit-ins and massive storming into buildings are totally unacceptable; furthermore, demonstrations and sit-ins need be coordinated with the university administration at least 48 hours ahead of the planned event to guarantee students, employees, and buildings safety and to guarantee not obstructing the educational process.
8. The university warns against the attempt of involving strangers – i.e. non ����һ������ians – to take part in these demonstrations. In case of violation, the university will take all necessary protective and legal measures to secure the safety of its students, its academic faculty members, its administrative staff, and its buildings.
9. The university regrets the state of general chaos prevailing in Egypt leading to a chaotic status that is in turn infiltrating into our educational institute.
10.   The German University in Cairo calls on all the patriotic forces to seek accuracy in dealing with this issue and to support the university in performing its educational role in a healthy university environment, to reduce the phenomenon of some students breaching the boundaries of decency and public moral norms with academic staff members, administrators and with their colleagues at the university which reflects a state of moral chaos that our community cannot accept.

بيان من الجامعة الألمانية بالقاهرة

إن الجامعة الألمانية لتأسف للأحداث التى حدثت فى الأيام الأخيرة بالجامعة أو خارج أسوارها وبعد أن قام بعض الطلاب بالشغب الخارج عن اللياقة وإحترام كرامة أعضاء هيئة التدريس وتهديد سلامة أبناء الجامعة ومنشأتها مما إضطر الجامعة الى أن تقوم بحقها الطبيعى فى إتخاذ الإجراءات الضرورية اللازمة للحفاظ على أمنها وكرامة أعضاء هيئة التدريس بها والحفاظ على سلامتهم وسلامة أبناءها الطلاب والإستمرار فى تحقيق أهدافها فى توفير المناخ العلمى والأكاديمى الملائم لتخريج طلابها بمستوى علمى راق لينافسوا قرنائهم محليا وعالميا ولتحقيق هذا الهدف يستلزم الأمر تعاون الجميع بدءا من أولياء أمورالطلاب وأبنائهم مع أعضاء هيئة التدريس بالجامعة وإداراتها فى جو يسمح للجميع للإنتاج والتقدم ودون إهدار للوقت والجهد الذى نحتاجهم جميعا فى تعويض مصر مافاتها من خطوات نحو التقدم العالمى والعلمى ودون الإخلال بنظام وقواعد الجامعة وإتاحة الفرصة للجميع بالتعبير الحر عن آرائهم فى إطار من الموضوعية والأداب العامة واللياقة والتنسيق مع إدارة الجامعة فى كل مايبتغونه من طموحات مع إحترام كامل للعملية التعليمية ومن يقومون بها بالجامعة ودون إخلال أو إقتحام لمنشآت ومعامل الجامعة وتعريض الطلاب والمنشآت للمخاطر ونحن على ثقة كبيرة من تعاون الجميع لتحقيق هذا الهدف الرفيع سعيا لأن نعمل جميعا فى الأخذ بالعملية التعليمية فى مصر الى الأمام وتعويض ما فاتنا من عقود أدت الى تأخرنا عن اللحاق بركب الدول المتقدمة.

ولذلك تود الجامعة الألمانية توضيح مايلي:

نظراً لما تمر به مصر حالياً في هذه المرحلة الحرجة والتي تتميز بحالة عدم الوضوح وغياب الحقيقة مما أدي الي وجود تيارات علي طرفي النقيض تقوم بفرض توجهاتها الايدلوجية والفكرية من فريق علي اخر وبما في ذلك الجامعات وطلابها – الأمر الذي يزيد من احتمالات وقوع مصادمات بدرجات متفاوتة ولذا فإن الجامعة من جانبها تؤكد علي الآتي:

1. الجامعات تتسم بالحيادية والاستقلال كمحراب للعلم المبني علي القيم والاحترام المتبادل بين كل فئات الجامعة – اساتذة وعاملين وطلاب – وكذلك فيما بين كل فئة منها بغض النظر عن أي توجه سياسي أو ديني أو ايدولوجي – وذلك في اطار الأعراف الجامعية المتعارف والمستقر عليها عالمياً ومحلياً.
2. ان موضوع الطلاب الذين تم فصلهم سواء لمدة اسبوعين (3طلاب) او فصل نهائي (2طالب السابق التحقيق معهم وانذارهم بالفصل فصلاً نهائياً) سببه التعدي بالقول والسب علي اعضاء لجنة تأديب الجامعة والتشهير بهم بطريقة لاتليق بطالب جامعي – وليس له أي علاقة بأي توجهات سياسية للطلاب ذاتهم – حيث ان جميع اسباب و بواعث القرارات السابقة جاءت ببواعث واسباب تعليمية وادارية صريحة وليس له اي صلة باسباب سياسية علي الإطلاق.
3. تمسك الجامعة بالحفاظ علي كرامتها المتمثلة في كرامة واحترام اساتذتها والعاملين بها وطلابها ولن تسمح لأحد بالتعدي عليهم بالقول أو الفعل أو التأثير عليهم مما يعيق عملهم ورسالتهم العلمية والتعليمية بأي حال من الأحوال.
4. تؤكد الجامعة أن حقوق الطلاب في حرية التعبير وابداء الرأي مكفولة بما يحقق احترام الرأي والرأي الآخر وبما لايضر ولايتعارض مع حقوق ومصالح الأخرين ولايؤثر علي سير العملية التعليمية.
5. الجامعة قد نبهت علي طلابها العديد من المرات بعدم دخول المباني وتعطيل الدراسة وعدم الاحتكاك بزملائهم للمحافظة علي سير العملية التعليمية وعلي سلامتهم وقد تم التنبيه عليهم لعدة مرات بمراسلات بتاريخ
   1/3/2011 ، 22/3/2011 ، 13/11/2011 وأخيراً في 22/2/2012.
6. الجامعة لاتنحاز ولاتؤيد ولاتعارض أي فصيل سياسي حيث ان الجامعات مستقلة ومحايدة سياسياً وايدلوجياً ويتضح ذلك من حالة المعيد الذي تم انهاء عقده فهو لم يتم التحقيق معه علي خلفية أراء سياسية أو لمشاركته في التظاهر ضد المجلس العسكري طبقاً لتصورات الطلبة والادعاء بان الجامعة تعاقب طلابها ومعيديها بسبب مواقفهم وآراءهم السياسية، وهو أمرمردود عليه بان السيد المعيد الموقوف عن العمل من خريجي الجامعة وكان نائبا لرئيس الاتحاد السابق ومع ذلك تم التعاقد مع الجامعة للعمل كمعيد على الرغم من ادعاء البعض أن هناك خلاف مع الإدارة له علاقة بمواقفه السابقة أثناء توليه رئاسة الاتحاد فكان من الأولى عدم تعيينه من الأساس إذا كانت إدارة الجامعة تنتهج هذا الأسلوب و لكن في الحقيقة انه قد تم التحقيق معه للأسباب الآتية :
   • الخروج عن واجبات وظيفته و التي تحتم عليه الحيادية التامة مع كافة الطلاب حيث قام بالتدخل بصورة عدائية ضد إتحاد الطلاب الحالي من خلال (e-mail) وصفهم فيه بعدم الشرعية والخيانة للنضال الطلابي و إضافة إلي ذلك قام بالهتاف علي الملأ من الطلاب خلال إجتماع طلابي مطالباً رئيس الإتحاد الحالي بالإستقالة و في نفس الإجتماع تعامل بعدوانية مع أحد زملائه الإداريين بالجامعة بشكل لا يليق .
   • و قد قام السيد المعيد في يوم 26/2/2012 بتقديم اعتذار رسمي للجامعة عن ما أقترفه من أخطاء وتعهد بالإلتزام باللوائح و الأحكام الداخلية للجامعة و جاري حالياً دراسة الإعتذار المقدم منه و سيتم اتخاذ قرار بشأنه قريباً.
7. الجامعة خصصت داخل الحرم الجامعي اماكن كساحات للتعبير عن الرأي بما لايعوق ولايؤثر علي العملية التعليمية ويحقق الأمن والسالمة للطلاب ولايجوز مطلقاً التظاهر والاعتصام داخل المباني أو دخولها في مجموعات كبيرة أو الاقتراب منها اثناء التظاهر أو الخروج عن المكان أو الزمن المحدد مع ضرورة التنسيق مسبقاً بمدة لاتقل عن 48 ساعة للحفاظ علي سلامة الطلاب والعاملين بالجامعة ومنشآتها وانتظام العملية التعليمية.
8. إن الجامعة تحذر من دخول اي غرباء أو عناصر من خارج مجتمع الجامعة الالمانية للاشتراك بأي حال من الأحوال في هذه التظاهرات وفي حالة المخالفة ستتخذ جميع الاجراءات الوقائية والقانونية اللازمة للمحافظة علي سلامة عاملين الجامعة الالمانية (اساتذة وعاملين وطلاب) ومنشآتها.
9. تأسف الجامعة لحالة الانفلات العام والاضطراب التي تسود المجتمع المصري وتعرض المجتمع بكامله لحالة فوضي وهناك تسرب لهذا الانفلات الي المؤسسة التعليمية التي نعمل بها.
10.   تهيب الجامعة بكل القوي الوطنية تحري الدقة في التعامل في هذا الشأن ومساعدة الجامعة علي اداء دورها التعليمي والتربوي في مناخ جامعي قويم للحد من ظاهرة تجاوز بعض الطلاب لحدود اللياقة والآداب العامة مع الاساتذة والعاملين وزملائهم بالجامعة والذي يعبر عن حالة من الانفلات الأخلاقي التي لايمكن للمجتمع قبولها.
